Although one can decide to move to Portugal, doing so brings along a huge number of legal implications and requirements to be met.
Alongside that, when it involves (and usually does) buying a property in Portugal, whether it’s a house, a land with a ruin, a farm with buildings, or other, there is a field of all the pitfalls where a foreigner can be caught out, which can cost a lot of money if not resolved in due time.
Many times, buildings are not properly licensed, areas are wrong, paperwork is missing or not yet done, properties are not in the records, they are in the tax records but not in the registration, they are in both, but not matching what’s on site, and so on…
And even when everything is okay to make a deed, that doesn’t mean your future plans are allowed. The paper of the property doesn’t show if you are able to build, build more, rebuild, instal yurts, make wooden houses, or any other plans you might have.
If this is not considered, you might end with a property you paid for, and without the possibility to do what you dreamt of…
So, our job is: see what are the client intentions, make all the legal checks to find possible problems with the purchase, negotiate with the seller to solve these issues, draft a promissory contract, in Portuguese and English that comprises all these matters and how to cope with them, follow up, so at the end you can have what we call a “clean purchase” – Even if you don’t want to, you can sell your property the day after, because all the issues are solved.
